NOTICE OF MEETING
FOR THE
LINDON CITY COUNCIL

It is hereby given that the Lindon City Council will hold a regularly scheduled meeting beginning at 7:00 p.m. on Tuesday, October 19, 2004 in the Lindon City Center, City Council Chambers, at 100 North State Street, Lindon, Utah. The agenda will consist of the following:

REGULAR SESSION - 7:00 P.M.

MINUTES - The minutes of the regular meeting of October 5, 2004 will be reviewed. - 5 minutes

OPEN SESSION - Citizens comments - 10 minutes

MAYOR’S COMMENTS/REPORT - 10 minutes

CONSENT AGENDA - No Items

CURRENT BUSINESS

1. Public Hearing - Adoption of Fighting Ordinance (#2004-10). The City Council will hear public comment and possibly act to adopt an ordinance which prevents “ultimate fighting” or “prize fighting” within the city limits of Lindon City. This new ordinance will add Chapter 8.22 - Fighting Contests, to the Lindon City Code. - 10 minutes

2. Public Hearing - Ordinance Amendment - Section 13.12.120 (#2004-11). The City Council will hear public comment and possibly act to amend Section 13.12.120 - Use of Sewer and Culinary Water Required, of the Lindon City Code. - 10 minutes

3. Preliminary Plat - Westlind Commercial Condominiums. This is a request by David Handy for approval to convert an existing building with three rental units into an industrial condominium project for the purpose of selling each unit. Approval of this request will also vacate Lot 7, Plat “A” of the Westlind Industrial Park Subdivision. The building is located in the LI zone at 1418 West 70 South. The Planning Commission recommended approval with no conditions. - 15 minutes

4. Preliminary Plat - Dirker Farms, Plat “B”. This is a request by Rick Murano for approval of a subdivision amendment which reconfigures some lots and removes certain property from Dirker Farms subdivision, Plat “A”. This is a request for approval of Dirker Farms subdivision, Plat “B”, in the R1-20 zone at 70 South 200 East. The Planning Commission recommended approval with one condition. - 60 minutes

5. Appeal Hearing - Denial of Conditional Use Permit - R2 Overlay Project. Evan G. Nixon, co-applicant for an R-2 Overlay project of 6 units on 1.25 acres, is appealing the decision of the Planning Commission to deny his application for a conditional use permit at 234 North 400 East in the R1-20 zone.- 60 minutes

6. Review and Action - Sanitary Sewer System Capital Facilities Plan Update. This is a request by staff for approval of the update to the capital facilities plan for the city’s sanitary sewer system. - 15 minutes

7. Review and Action - 900 East, 140 North Speed Study Update. This is a report requested by the Council to determine current speeds along 900 East and 140 North streets where speed humps were installed four years ago. - 10 minutes

8. Resolution - 800 North/1200 East Access Management Plan (#2004-13). This is a request by staff for approval of a resolution which adopts an access management plan for the area around the proposed development of Highlands at Bald Mountain. The streets involved are 1200 East and 800 North. This is a requirement by UDOT before the approved corridor preservation funds will be made available.- 10 minutes

9. Review and Action - Property Purchases. This is a request by staff for approval of the purchase of two parcels of property. The first parcel is .86 of an acre for the southerly expansion of Pheasant Brook Park. The other parcel is a 12 foot strip along the 1200 East right of way. - 15 minutes

Lindon City, in compliance with the Americans With Disabilities Act, provides accommodations and auxiliary communicative aids and services for all those citizens in need of assistance. Persons requesting these accommodations for City-sponsored public meetings, services, programs, or events should call Venla Gubler at 785-5043, giving her at least 24 hours notice.
