Criminal Justice Information During a Domestic Violence Case
Investigation: Officers will respond and investigate reports of criminal activity and domestic violence. A police report is completed for each incident.
Charges Filed: After investigation, a defendant can be charged and/or physically arrested.
Summons/Bail: If charges were referred or the defendant is given a citation, they can be ordered to appear in court. If the defendant was physically arrested, they will be taken to jail where bail will be determined. If bail is posted, the defendant will be released and given a court date. A no contact jail release agreement must be signed.
First Appearance/Arraignment: The defendant will be required to appear before a judge. At this time, the no contact order will expire and the court will assess the necessity of a criminal protective order. During this appearance, the defendant will enter a plea:
*Guilty Plea - Defendant may be sentenced then or at a later date.
*Not Guilty Plea - Defendant will be given another court date for a pre-trial hearing.
